A quick summary
You can use this platform and services only if you are above the age of 13. You are not legally barred from using our platform.
Please take a look at our Privacy policy which highlights how we use the information that you provide to us and that we collect. Through your use of the platform you consent to the collection and use of this information, including the transfer of this information to other countries for storage, processing and use by us and our affiliates.
For any content that you provide, you need to comply with the applicable laws and regulations of the land and you are responsible for the same. Chwippy only provides a platform for you to use. Any content that you obtain, see, use is at your own risk. We do not endorse, represent, support or guarantee the veracity, truthfulness or reliability of any content that is posted on the platform.
All content that is posted on the platform is the sole responsibility of the person posting. We do not monitor and we do not take responsibility of any content that is posted.
We reserve the right to remove Content that violates our guidelines, laws of the land, the User Agreement, including for example, copyright or trademark violations or other intellectual property misappropriation, impersonation, unlawful conduct, or harassment.
If you believe that your Content has been copied in a way that constitutes copyright infringement, please report this by mailing us on support@chwippy.com
The rights to any content you submit, post or display on or through the platform is yours.
By submitting, posting or displaying content on the platform, and unless we indicate otherwise, you grant us and our affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant us and our affiliates and sub-licenses the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify us and our affiliates for all claims resulting from content you supply. We has the right but not the obligation to monitor and edit or remove any activity or content. We take no responsibility and assumes no liability for any content posted by you. Such additional uses by us, or other companies, organizations or individuals, is made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the platform
Our platform will provide personalized recommendations to make the service more relevant for you. We will recommend content, advertising, and other information to you based on what we know about your and others’ interests from use of our platform. How we handle your data is highlighted in the Privacy policy. You agree that we and our third-party providers and partners may place advertising on the platform or in connection with the display of Content or information from the Services whether submitted by you or others.
You must respect our rights and not do the following
Use our use branding, logos, icons, user interface elements, product or brand look and feel, designs, photographs, videos, or any other materials Chwippy makes available via the platform
violate our copyrights, trademarks, or other intellectual property rights, including by using the platform to submit, display, post, create, or generate any infringing content;
Modify, copy, archive, download, upload, disclose, distribute, sell, syndicate, broadcast, display, make available, make derivatives of, or otherwise use the platform, other than temporary files that are automatically cached by your web browser for display purposes, as otherwise expressly permitted in these Terms, as otherwise expressly permitted by us in writing, or as enabled by the platform’s intended functionality
Attempt to access the platform through unauthorized third-party applications, solicit login credentials from other users, or buy, sell, rent, or lease access to your account
access, tamper with, or use non-public areas of the platform, our computer systems, or the technical delivery systems of our service providers
probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures
reverse engineer, duplicate, decompile, disassemble, or decode the platform or otherwise extract the source code of the software
Try to extract other user’s information through scraping, robots, crawlers or automated means
use or develop any third-party applications that interact with the platform or other users’ content or information
upload viruses or other malicious code or otherwise compromise, bypass, hack or circumvent the security of the platform
violate any applicable law or regulation in connection with your access to or use of the Services
You may need to create an account to use some of the features of our platform. You are responsible for safeguarding your account by using a strong password and limit its use to this account. You will ensure that the password is not shared and used by anyone else other than you. We cannot and will not be liable for any loss or damage arising from your failure to comply with the same.
We may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your account, and you may not be able to opt-out from receiving them.
You can delete your account at any time from your Account Profile section. On deletion your account, your name and public profile will no longer be visible.
We give you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you as part of the Services. This license has the sole purpose of enabling you to use the platform as provided on Chwippy, in the manner permitted by these Terms.
The Services are protected by copyright, trademark, and other laws of India and other countries. Nothing in the Terms gives you a right to use the Chwippy’s name or any of the trademarks, logos, domain names, other distinctive brand features, and other proprietary rights. All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain our and our licensors' exclusive property.
You agree, to the extent permitted by law, to indemnify, defend, and hold harmless Chwippy, our employees, affiliates, directors, officers, stockholders, licensors, and agents from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including legal fees) due to, arising out of, or relating in any way to access to or use of the platform, or any products or services provided by a third party in connection with the Services, even if recommended, made available, or approved by us, your content, including infringement claims related to your content, your breach of these Terms or any applicable law or regulation or your negligence or willful misconduct.
We will strive to keep the platform up and running and free of glitches but we do not guarantee that we will succeed. Your access to and use of the Services or any Content are at your own risk. You understand and agree that the Services are provided to you on an “AS IS” and “AS AVAILABLE” basis and to the extent permitted by law and to the extent permitted by law without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We DO NOT represent or warrant that the services will always be secure, error-free, or timely, the platform will always function without delays, disruptions, or imperfections, or that any content, user content, or information you obtain on or through the platform will be timely or accurate.
We do not take any responsibility or assume liability for any content that you, another user, or a third party creates, uploads, posts, sends, receives, or stores on or through our platform. You understand and agree that you may be exposed to content that might be offensive, illegal, misleading, or otherwise inappropriate, none of which we will be responsible for.
To the maximum extent permitted by applicable law, chwippy, our employees, Shareholders, directors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the platform; any conduct or content of any third party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; any content obtained from the platform; or unauthorized access, use or alteration of your content. in no event shall the aggregate liability of the Chwippy entities exceed the greater of Rupees one thousand (Rs.1000) or the amount you paid us, if any, in the past six months for the platform giving rise to the claim. the limitations of this subsection shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not the Chwippy has been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
We may revise these Terms from time to time. The changes will not be retroactive, and the most current version of the Terms, will govern our relationship with you. We will try to notify you of material revisions, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
The laws of India, excluding its choice of law provisions, will govern these Terms and any dispute that arises between you and us. All disputes related to these Terms or the Services will be brought solely in the federal or state courts located in Bangalore, Karnataka, India and you consent to personal jurisdiction and waive any objection as to inconvenient forum.
